1. Acceptance of Terms

By downloading, accessing, or using NutriShot AI ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

NutriShot AI is an AI-powered nutrition tracking application that allows users to scan meals, log food intake, and receive estimated calorie and macro breakdowns. The App uses third-party AI services to process food images and provide nutritional estimates.

3. Fair Use Policy

NutriShot AI relies on third-party AI services to analyze your meals. To ensure a reliable experience for all users and to manage costs responsibly, the following fair use guidelines apply:

• Reasonable Personal Use: The App is intended for individual, personal nutrition tracking. Excessive automated, scripted, or bulk requests are not permitted.
• Scan Limits: Free and paid plans include a reasonable number of meal scans per day. If you exceed the limits associated with your plan, additional scans may be temporarily restricted until the next billing cycle or day.
• No Abuse or Misuse: You may not use the App to submit non-food images, spam the AI service, reverse-engineer the AI models, or otherwise misuse the scanning functionality.
• No Redistribution: You may not resell, redistribute, or commercially exploit the AI-generated nutritional data or analysis from the App.
• Rate Limiting: We reserve the right to implement rate limits to protect service quality. Users who consistently exceed fair use thresholds may be notified and asked to adjust their usage or upgrade their plan.

We reserve the right to suspend or restrict access to accounts that violate this Fair Use Policy. We will make reasonable efforts to contact you before taking action, except in cases of severe abuse.

4. User Accounts

You may be required to authenticate via a third-party OAuth provider (e.g., Google) to use the App. You are responsible for maintaining the security of your account credentials and for all activity under your account.

5. AI-Generated Content

Nutritional estimates provided by the App are generated by AI and are approximate. They should not be treated as medical or dietary advice. Always consult a qualified healthcare professional for specific dietary needs. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

6. Intellectual Property

All content, features, and functionality of the App are owned by Questopia LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Questopia LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms, including breach of the Fair Use Policy. You may stop using the App and request deletion of your account at any time.

9. Changes to Terms

We may update these Terms from time to time. The latest version will always be posted here with the effective date updated. Continued use of the App after changes constitutes acceptance of the revised Terms.
